(Avon) — A mental evaluation has found that a 90-year-old Avon man is competent to stand trial for allegedly suffocating his ailing 85-year-old wife to end her suffering.

Prosecutors and attorneys for Robert Shaw of Avon agreed Monday that the court can consider the mental evaluation finding him sane at the time of the 2008 incident and able to assist in his own defense.

The judge in Lorain County is expected to make an official ruling this week to include the findings in evidence at Shaw's trial in June.

The (Lorain) Morning Journal reports that Shaw faces aggravated murder and other charges in the November 2008 death of his wife Virginia at their home in Avon.

Previous evaluations also found Shaw competent for trial.
